These guidelines outline the procedures for filing copyright infringement notices and counter-notices, handling repeat infringers, and provide contact information for parties submitting infringement notifications on behalf of third parties.
1. Reporting Copyright Infringements
If you believe your intellectual property rights have been violated by Castle or a third party who uploaded content on our platform, please provide the following information to our designated copyright agent (listed below). Your copyright complaint notice must include:
A description of the infringing work (including a copy of the work if possible);
Specific URLs or app sections on Castle where the infringing content is located (if applicable);
A description of the copyrighted work you claim has been infringed;
Your full legal name and an electronic or physical signature confirming your authorization to act on behalf of the copyright owner;
A statement that rental or lending of the work (whether for a fee or otherwise) is not authorized;
A statement that all information in the notification is accurate, provided under penalty of perjury.
We will identify valid notices within 24 hours and process them promptly, removing or disabling access to the infringing content within 48 hours of verification.
2. The Counter-Notification Process
If you believe your content was removed in error, submit a counter-notice containing at least the following information:
The URL of the allegedly infringing material that was removed;
A declaration of truth, made under penalty of perjury;
A statement confirming you are authorized to act on the copyright holder’s behalf (i.e., as an owner or exclusive licensee);
Your signature and complete contact information.
We will forward your counter-notice to the initial complaining party. If we do not receive an official legal notice from the complainant within 10–14 business days, we will restore your content in accordance with DMCA guidelines.
3. Recurring Infringers Policy
Castle has a zero-tolerance policy for repeated copyright violations. Users who receive three or more valid takedown warnings will have their access to Castle’s website, app, and streaming services abruptly and permanently terminated.
4. Misuse of the DMCA Process
You may not submit false takedown notices, counter-notices, or inaccurate information. Such misuse may result in legal consequences, including potential liability for you or the users whose material was improperly removed. All notices must be submitted in good faith.
